Property Due Diligence & Title Search in Delhi
Title search, encumbrance check and approval verification for Delhi property — DDA, MCD, RERA-Delhi and revenue records.
Property due diligence in Delhi is the verification of ownership, encumbrances and approvals before money changes hands. In Delhi specifically, that means tracing the chain of title through the sub-registrar’s records, checking the revenue entries that determine who the records recognise as owner, and confirming that the construction on the ground matches what was sanctioned.
What a Delhi title search covers
- Chain of title — the complete history of ownership from the first allotment or conveyance to the present seller, worked back through sale deeds, gift deeds, partition deeds and succession documents.
- Encumbrance certificate — registered mortgages, charges, court attachments and lis pendens, obtained from the sub-registrar’s office rather than inferred from the sale deed.
- Revenue and municipal records — mutation entries and property-tax records, confirming the seller is the recorded owner and not merely a holder of papers.
- Sanctions and approvals — sanctioned building plan and completion or occupancy certificate from the municipal authority, and for under-construction property the RERA-Delhi registration and the disclosures filed with it.
Delhi-specific complications
Delhi property carries a set of issues that do not arise in the same form elsewhere. Power-of-attorney sales, DDA allotments and their transfer conditions, cooperative group housing society flats and the society’s no-objection requirement, and the registration status of properties in regularised and unauthorised colonies are all matters that change what can safely be bought and on what terms. A title that looks clean in a sale deed may still carry a DDA or society restriction that prevents or delays transfer.
The power of attorney problem
A large share of Delhi property transactions involve a power of attorney executed either by an owner who is abroad or by a seller acting through an attorney. Two risks recur. First, an attorney acting beyond the authority actually granted. Second, and more serious, the treatment of a power of attorney as though it transferred ownership — which it does not. A buyer who pays on the strength of a power of attorney, without a registered conveyance in the seller’s own right or a duly executed sale deed, may hold nothing enforceable.
What you receive
A written title due-diligence report that lists every document examined, every discrepancy found, and a clear recommendation: proceed, proceed subject to conditions, or do not proceed. The report is signed by the advocate and is prepared for the specific transaction, not issued from a template.

Frequently asked questions
How far back should a Delhi title search go?
Thirteen years is the working minimum for encumbrance purposes, extended to thirty years where the property has changed hands through inheritance, partition or a power-of-attorney sale. The period is set by what the chain of documents actually shows.
Does a registered sale deed prove clear title?
No. Registration establishes that a document was executed and registered. It does not establish that the seller held clear or marketable title, or that the property is free of encumbrances.
Can I buy a property held under a power of attorney?
Only with care. The power of attorney must be valid, properly executed and within its terms, and the underlying ownership must be independently verified. A power of attorney is not a substitute for a conveyance.
How long does due diligence take?
For a straightforward Delhi flat with clear records, usually one to two weeks. Properties involving society approvals, DDA conditions or an inherited chain take longer, and the timeline is confirmed in writing before work begins.
