Property & Real Estate Advisory
Property due diligence, title verification, deed drafting and registration and NRI property services — fixed-scope, fixed-fee advisory for Delhi & Gurugram.
Buying property in Delhi or Gurugram involves more than agreeing on a price and signing an agreement to sell. Behind every transaction lies a set of legal facts about the property — who actually owns it, whether it is free of disputes and encumbrances, whether it was built in compliance with applicable law, and whether the seller has the legal authority to transfer it. Due diligence is the process of verifying these facts before money changes hands, rather than discovering problems after.
A property transaction in Delhi NCR is a chain of documents — and a transaction is only as safe as the weakest link in that chain. This advisory service exists to make sure you never discover that weak link after paying. Every engagement is fixed-scope and fixed-fee, with a signed, reasoned report at the end.
1. Property Due Diligence (Delhi & Gurugram)
Before you pay an advance the chamber verifies:
- Chain of title — the complete history of ownership for the last 13 years ( extendable to 30 years if required) from the first allotment or conveyance to the present seller.
- Encumbrance search — registered mortgages, charges, lis pendens, court attachments and pending litigation, through the Sub-Registrar records and the borrower/charge registries.
- Revenue and municipal records — mutation entries, jamabandi (in Delhi), land-record extracts in Haryana, property-tax records, and the seller’s identity as the recorded owner.
- Approvals and sanctions — sanctioned building plan, completion/occupancy certificate, and for under-construction property, the project’s RERA registration and its Q-tag disclosures (litigation history, delay record, escrow compliance).
- Special Delhi issues — Power-of-Attorney sales, cooperative society plots, DDA allotments, Ejari-type tenancy records, and the regularisation status of unauthorised colonies.
- Special Gurugram issues — builder-buyer agreements, CLP payment plans, project delay records before HRERA, and license-based (colonisation) land titles.
You receive a title due-diligence report that lists every document seen, every risk found, and a clear recommendation: proceed, proceed with conditions, or walk away.
2. Drafting and review of transaction documents
- Sale deeds and conveyance deeds — drafted to pass clean title, with covenants that survive registration.
- Agreements to sell — with title warranties, possession conditions, milestones and a properly structured default clause.
- Builder-buyer agreements — review and negotiation before you sign: possession dates with teeth, refund triggers, area escalation caps, maintenance handover and compensation clauses.
- Gift deeds, relinquishment deeds, release deeds and family settlements — the quiet documents that prevent the loudest disputes.
3. Power of Attorney — drafting and verification
PoAs are among the most abused documents in NCR property law. The chamber drafts special and general PoAs with the right powers and the right safeguards, and verifies existing PoAs for authority, revocation risk and including the specific formalities (registration, authentication before Indian consulates) when a PoA is executed abroad.
6. NRI property services
- Purchase and sale advisory — what NRIs can lawfully buy (and cannot: agricultural land, plantations, farmhouses), funding through NRE/NRO/FCNR accounts, and tax structuring of the transaction (TDS on purchase and sale, capital-gains planning).
- Power of Attorney from abroad — correctly drafted, attested before the Indian consulate or notarised-and-apostilled, and adjudicated in India so it actually works at the Sub-Registrar’s office.
- Property management from abroad — PoA-based management and tenancy structuring.
Fixed, transparent fees: Due diligence and drafting engagements are quoted as fixed fees after a free document checklist review. Litigation, if ever needed later, begins with a record that is already complete.
Diligence and drafting work is quoted as a fixed fee in writing before the engagement begins.
