Real Estate Matters
Litigation and dispute resolution for property across Delhi and Gurugram — title disputes, builder delay cases, RERA complaints, possession and refund claims.
Few places in India concentrate as much property value and as much property litigation as Delhi and Gurugram. This chamber represents homebuyers, landowners, builders and investors in disputes that range from a single flat to entire housing projects.
What we handle
- Builder delay and refund claims — under Section 18 of the Real Estate (Regulation and Development) Act, 2016, homebuyers of RERA-registered projects can choose either possession with compensation for delay, or full refund with interest. Haryana RERA (HRERA, Gurugram) and the Delhi RERA authority both enforce this and both have made it clear in recent years that delay attracts interest, period.
- RERA complaints — non-registration of projects, false advertisements, structural defects within the defect-liability period, unilateral changes to plans and forfeiture of booking amounts. Filing court fees are modest (around ₹1,000 for homebuyers in both Haryana and Delhi), which makes RERA an efficient first stop.
- Title disputes — competing sale deeds, forged documents, fraudulent mutations, ancestral property sold without consent, and specific-performance litigation to enforce agreements to sell.
- Land acquisition and compensation — challenges and enhancement claims under the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013.
- Enforcement of decrees — execution of possession and money decrees against recalcitrant builders and sellers.
The Delhi–Gurugram property landscape
Delhi property carries its own complications — the Delhi Land Reforms Act, cooperative societies,
DDA allotments, Power-of-Attorney sales and the long-running question of regularisation. Gurugram’s issues are different: builder-buyer agreements drafted by large developers, project delays, escrow-account misuse and HRERA enforcement practice. This chamber has worked both sides of the NCR for years and knows the documents, the forums and the regulators.
Before you buy: see the advisory service on Property Due Diligence. Due diligence routinely saves years of litigation.
No property matter proceeds without a title chain review. A week of diligence is cheaper than a decade of litigation.
