DILIGENTLY PURSUING YOUR CASES FOR EARLY / EXPEDITIOUS DISPOSAL
I have been seeing lot of posts suggesting that the Indian Judicial System is slow and it takes years to get any decisions.
I would like to share my opinion on this which is based on whatever I have learned about the system over the years.
If you have competent lawyers and they pursue the matters diligently by taking the steps mentioned below, then you can expedite the disposal of your cases.
-
Oppose unnecessary adjournments.
-
Keep moving early hearing / early / time bound disposal applications, Writ Petitions, SLP’s) whenever necessary.
-
File All documentation proactively
I am also sharing two Court orders below wherein passed by Different High Courts wherein filing Writ Petitions have expedited the cases for the clients.
1. DELHI HIGH COURT – CM (M) 31/2021 ORDER DATED 27.02.2021
2. HIGH COURT OF PUNJAB & HARYANA – CWP-10296-2020 ORDER DATED 21.07.2020
There are various provisions in the different laws for expeditious hearings however, they need to be invoked by moving appropriate applications.
It is pertinent to mention here that every application, every reply to application, every petition takes time and increases the cost for the lawyers but it is important for parties / litigants to know that such provisions exist and can be invoked if they wish to do so.
Finally, I would conclude by saying Indian laws provide various remedies for expediting your cases however, invoking these provisions / remedies would take some effort / expense.
A short consultation can clarify your position before deadlines pass.
