Succession & Estate Planning for HNIs
Will drafting, property transfer and mutation advisory, legal-heir and succession certificates, and family settlement structuring — discreet, end-to-end estate planning for HNI families.
Succession planning for a significant estate is not a one-time form-filling exercise. It requires a clear understanding of the family’s assets, relationships, and objectives, translated into a legally sound structure — whether that is a carefully drafted will, one or more trusts, or a combination of both — and revisited as the family’s circumstances change over time. Given the range of instruments available and the specific considerations that apply to business ownership, cross-border assets, and vulnerable beneficiaries, the appropriate structure is rarely the same for any two families, even where the overall value of the estate is comparable.
Estate disputes in India are precipitated by absent documents. A well-drafted will, a properly maintained record of assets and a clear communication plan prevent the litigation that consumes families for a decade. This chamber designs exactly that: discreet, legally airtight succession plans for high-net-worth families, business owners and NRIs.
1. Will drafting and review
- Will structure — proper identification of the testator, executors, beneficiaries and residue; specific bequests and residuary clauses that actually cover everything.
- Execution formalities — attestation by two independent witnesses, registration (optional but powerful), and guarding against the two most common grounds on which Indian wills are challenged: suspicious circumstances and unsoundness of mind.
- Safe custody and communication — where the will lives, and how executors find it.
- Living documents — coordination of wills with nominations, joint holdings, partnership deeds, and shareholder agreements so that no asset falls outside the plan.
2. Property transfer and mutation advisory
Death triggers paperwork: transfer of flats in cooperative societies, mutation in municipal and revenue records, update of DDA/allotment records, and transmission of shares and bank accounts. The chamber handles the full sequence — the documents no one tells you about until they are missing.
3. Legal heir certificates and succession certificates
- Legal heir certificate — identification of heirs for utility, tenancy and employment purposes, from the revenue authorities.
- Succession certificate — the court-issued certificate that unlocks debts and securities (bank balances, shares, mutual funds). The chamber files and prosecutes these petitions in the Delhi and Gurgaon courts.
- Probate and letters of administration — where the will requires probate (mandatory for wills in certain territories, and always prudent for immovable property in Delhi), the chamber obtains it and defends it against challenges.
4. Family settlement and structuring
Where relationships permit, a signed family settlement or a properly structured partition is faster, cheaper and kinder than any will contest. The chamber structures settlements that satisfy revenue-record requirements, stamp-duty rules and tax law (including the Section 56 and clubbing-provision traps), so the arrangement holds not just in the family, but in every office that must give effect to it.
